1. What this is

Benchmark Locator ("the app," "we," "us") is a reference tool that shows NGS control monument data on the PLSS section grid, sourced from the NOAA National Geodetic Survey and the BLM National PLSS CadNSDI. Using the app, in any form — the website, the installed app, or the PWA — means you agree to these terms.

This is reference data, not a survey. Benchmark Locator shows you published records to help you plan and locate work. It is not a substitute for a licensed land survey, professional judgment, or field verification. A monument's published condition may be out of date — always verify a mark's existence and condition in the field before relying on it.

2. Accounts

Signing in: By email, using a one-time link or a 6-digit code. No password is created or stored.
One account, one email: You're responsible for keeping access to the email address your account uses — it's the only way to sign in.
Free to use: An account is not required to view sections, marks, and datasheets, or to export a CSV.

3. Pro subscription

Price: $29/year, billed annually. No monthly option, no free trial.
What Pro adds: Offline caching of map tiles and section data for areas you've visited, so they're available without a signal.
Billing: Handled entirely by Stripe. We never see or store your card details.
Cancelling: Any time, from the Account page's billing portal. Pro access continues until the end of the period you already paid for.
Refunds: No refunds for partial periods, except as required by law.

4. Acceptable use

Use the app for its intended purpose — finding and exporting control monument data for surveying and related work. Don't:

Attempt to disrupt, overload, or gain unauthorized access to the service
Use the CSV email feature to send unsolicited mail to third parties
Resell or redistribute the app's data as a competing bulk data service
Reverse engineer the app beyond what applicable law permits

5. The data itself

Monument records come from NGS's public datasheets and are refreshed monthly; section boundaries come from BLM's public PLSS data. We don't alter the substance of published records — coordinates are passed through as published, without rounding. We aren't responsible for errors, omissions, or delays in the underlying government data itself.

6. Disclaimer of warranties

The app is provided "as is," without warranties of any kind, express or implied, including fitness for a particular purpose. We don't guarantee the app will be uninterrupted, error-free, or that any monument's published condition is current.

7. Limitation of liability

To the fullest extent permitted by law, Benchmark Locator is not liable for any indirect, incidental, or consequential damages arising from use of the app or reliance on the data it displays — including damages arising from a survey, boundary determination, or fieldwork based on that data. Always verify monument data in the field.

8. Account termination

You may delete your account at any time from the Account page, which cancels any active subscription. We may suspend or terminate access for use that violates section 4 above.

9. Changes to these terms

We'll update the date at the top of this page when these terms change in a way that matters. Continuing to use the app afterward means you accept the update.

10. Governing law

These terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles.
